What Personal Data We Collect
We generally collect your personal data in three ways as outlined in the sections below: Personal Data You Provide, Automatically Collected Personal Data, Personal Data From Other Sources.
Personal Data You Provide
- Profile Information. We may collect personal data that you provide when you set up an account, including your name, email address, and password. You may be able to add other personal data to your profile, such as a bio or a profile photo.
- U****ser Content. We collect the content you choose to input into, and generate through, the Services, including chat prompts, text, images, audio, files, comments, and associated metadata.
- Purchase information. When you make a purchase or payment on or through the Services, we may collect personal data relating to the purchase or payment transaction, such as payment account information, billing address, and the services or items you purchased.
- Surveys, Research, and Promotions Information. We collect information you provide if you choose to participate in a survey, research, promotion, contest, marketing campaign, or event conducted or sponsored by us.
- Information When You Contact Us. When you contact us, we may collect the personal data you send us, such as proof of identity or age, feedback or inquiries about your use of the Services or information about possible violations of our Terms of Service (our “Terms”), or other policies.
- Technical Information. We may collect certain device and network connection information when you access the Services. This information may include your device model, Device Identifier and Basic Information，operating system, IP address, and system language. We may also collect service-related, diagnostic, and performance information, including crash reports and performance logs.
- Usage Information. We may collect information about how you engage with the Services, including information about the duration and frequency of your use, and your settings.
- Cookies. We may use cookies and similar tracking technologies to operate and provide the Services. For example, we may use cookies to remember your language preferences, and for security purposes. We may also use these technologies for marketing purposes. To learn more about our use of cookies, please see our “How We Use Cookies and Similar Technologies” section below. We will obtain your consent to our use of cookies where required by law.
- Log-in, Sign-up, or Linked Services. If you choose to sign-up or log-in to the Services using a third-party service (such as Google), we may collect information from the service, such as your email, account ID, avatar url, and/or access token. The personal data we collect may depend on the privacy settings you have set with the third-party service. We suggest that you check the privacy and data policies and practices of the third-party service to learn how they handle personal data.
- Payment and Transaction Fulfillment Providers. We may receive information about you from payment and transaction fulfillment providers, such as payment confirmation details, and information about the Creator AI Agents that you have purchased.
- Provide and administer the Services.
- Provide our purchase features, including sharing your information with payment fulfillment providers, in order to process your orders.
- Notify you about changes to the services and communicate with you.
- To send you marketing communications, where you have signed up to receive them.
- Maintain and enhance the safety, security, and stability of the Services by identifying and addressing technical or security issues or problems (such as technical bugs, spam accounts, and detecting abuse, fraud, and illegal activity).
- Review, improve, and develop the Services, including by monitoring interactions and usage across your devices, analysing how people are using it, and by improving our technology.
- Comply with our legal obligations, or as necessary to perform tasks in the public interest, or to protect the vital interests of our users and other people.
- Protect the integrity of the Services and ensure your safety, including by enforcing our Terms of Service and other applicable policies, and by safeguarding our legal rights and commercial interests. In addition, where permitted under applicable law, we may also collect, use and disclose your personal data for the following purposes:
- responding to, processing and handling your queries, requests, feedback and suggestions, or otherwise providing customer support;
- verifying your identity;
- managing our administrative and business operations and complying with internal policies and procedures;
- facilitating our business asset transactions (which may extend to any mergers, acquisitions or asset sales);
- making media announcements and providing responses to media queries;
- in connection with any claims, actions or proceedings (including but not limited to drafting and reviewing documents, transaction documentation, obtaining legal advice, and facilitating dispute resolution), and/or protecting and enforcing our contractual and legal rights and obligations;
- managing and preparing reports on incidents and accidents; and/or
- any other purpose relating to or reasonably necessary for any of the above. In addition to the matters set forth above, subject to and in accordance with applicable law, you shall be ++deemed to have consented++ to us collecting, using, disclosing and sharing amongst ourselves your personal data, and disclosing such personal data to our authorised service providers and relevant third parties:
- where in response to a request for your personal data in connection with identified purposes, you voluntarily provide such personal data to us for such purpose(s) and it is reasonable that you would voluntarily provide such personal data; and
- where the collection, use and/or disclosure of your personal data is reasonably necessary for the conclusion and/or performance of a contract, between you and us or any other organisation entered into at your request, which may include recipients of your personal data not indicated in this Privacy Policy.
- for our legitimate interests or the legitimate interests of another person (but not for sending you direct marketing messages unless you have otherwise provided your consent), including without limitation for the following purposes:
- any investigations or proceedings;
- fraud detection and prevention;
- detection and prevention of misuse of services by users; and
- we may collect your personal data from any entity in our corporate group, we may use your personal data, and any entity in our corporate group may disclose your personal data to us, for improving our products, services, processes or business, understanding customer preferences and personalising experiences and recommendations (regardless whether you are an existing or prospective customer of any of the entities in our corporate group).
- Service Providers and Third Party Platforms
- Payment service providers;
- Analytics service providers that assist us in providing, supporting, or developing our Services and/or other products or services, as well as improving and optimising the same;
- Hosting, maintenance, backup, storage, virtual infrastructure providers.
- Our Corporate Group We may disclose your personal data to other entities within our corporate group. These entities may process the personal data and other information to support our Services and provide various functions, such as storage, content delivery, security, research and development, analytics, customer and technical support, and content moderation.
- Others
- Share Feature. You may use the “Share” feature to share selected User Content, which will be transmitted in its original form, with others. By doing so, you (i) explicitly consent to the processing and temporary disclosure of the selected User Content to the recipient(s); and (ii) represent that you have obtained explicit consent from any third parties whose personal data (if any) is included, as well as any necessary proper authorization. We process this data strictly to facilitate the sharing function as requested by you.
- Corporate Transactions. Your personal data may be disclosed to third parties in connection with a corporate transaction, such as a merger, sale of assets or shares, reorganization, financing, change of control, or acquisition of all or a portion of our business.
- Legal Obligations and Rights. We may access, preserve, and share your personal data with law enforcement agencies, public authorities, copyright holders, or other third parties if we have good faith belief that it is necessary to:
- comply with applicable law, legal process or government requests, as consistent with internationally recognised standards;
- protect the rights, property, and safety of our users, copyright holders, and others as required or permitted by law;
- investigate potential violations of and enforce our Terms or any other applicable terms, policies, or standards; or
- detect, investigate, prevent, or address misleading activity, copyright infringement, or other illegal activity.
